Terms of Use — Jibu Quiz

1. Agreement

These Terms of Use ("Terms") are a binding agreement between you and Extra Brains (Pty) Ltd ("Extra Brains," "we," "us," or "our") governing your access to and use of the Jibu Quiz mobile application for Android and iOS (the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Where you obtain the App from the Apple App Store or Google Play, those platforms' standard terms may also apply between you and Apple or Google; where those terms conflict with these Terms regarding the App itself, these Terms govern your relationship with Extra Brains.

2. Licence to use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial entertainment, in accordance with the applicable store rules. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of the App, except where such restrictions are prohibited by law.

3. Accounts and security

Some features require an account. You agree to provide accurate information and to keep your credentials secure. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms, pose a security risk, or harm other users or the service.

4. Acceptable use

You agree not to:

• Cheat, exploit bugs, use unauthorised automation, or interfere with the App, servers, or other users' experience;
• Harass, abuse, threaten, or impersonate others, or post unlawful, defamatory, obscene, or infringing content;
• Attempt to gain unauthorised access to systems, data, or other users' accounts;
• Use the App in violation of applicable law or third-party rights.

Multiplayer, friends, leaderboards, and similar features must be used respectfully. We may remove content or restrict features where necessary.

5. Subscriptions and in-app purchases

The App may offer optional paid features or subscriptions (for example a Premium subscription or similarly named offering as shown in the App and in the store). Subscriptions renew automatically until you cancel them, for the term and at the price displayed in the App Store or Google Play at the time of purchase (prices may vary by region and may change with notice as required by the platform).

Payment and billing are processed by Apple or Google, not by us directly. Your use of those payment methods is subject to their terms and privacy policies.

How to cancel: On iOS, cancel in Settings → Apple ID → Subscriptions (or the equivalent path in your device settings). On Android, cancel in the Google Play app under Payments & subscriptions → Subscriptions. You must cancel before the renewal date to avoid being charged for the next period.

Refunds are handled according to Apple's or Google's policies and applicable law. If you have a billing issue, contact the platform first; you may also contact us at support@extrabrains.co.za and we will help where we reasonably can.

Free trials or introductory offers, if offered, are described in the store listing and at purchase; unless stated otherwise, they convert to a paid subscription unless cancelled before the trial ends.

6. Intellectual property

The App, including its name, branding, graphics, text, software, and related content, is owned by Extra Brains or its licensors and is protected by intellectual property laws. Except for the limited licence above, no rights are granted to you.

7. Privacy

Our collection and use of personal information is described in the Privacy Policy. By using the App, you acknowledge that policy.

8. Service changes and availability

We may update, modify, or discontinue features or the App with or without notice, subject to applicable law and store requirements. We do not guarantee uninterrupted or error-free operation.

9. Disclaimer and limitation of liability

To the fullest extent permitted by applicable law, the App is provided "as is" without warranties of any kind, whether express or implied. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under law (including gross negligence or wilful misconduct where applicable).

To the extent permitted by law, Extra Brains and its directors, employees, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the App. Our aggregate liability arising out of these Terms or the App is limited to the greater of (a) the amount you paid us for the App or subscriptions in the twelve months before the claim or (b) where no such payment applies, a reasonable minimal amount, except where law requires otherwise.

10. Indemnity

You agree to indemnify and hold harmless Extra Brains from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the App or violation of these Terms, to the extent permitted by law.

11. Termination

You may stop using the App at any time. We may suspend or terminate access if you breach these Terms or if we discontinue the service. Provisions that by their nature should survive (including intellectual property, disclaimers, and limitations) will survive termination.

12. Governing law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law rules. Courts in South Africa have non-exclusive jurisdiction, subject to any mandatory rights you have as a consumer in your country of residence.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and update the effective date. Material changes may be communicated through the App or other reasonable means where required by law or by the app stores. Continued use after changes constitutes acceptance where permitted by law.
